What is a bank guarantee?

A bank guarantee guarantees the buyer’s payments to the building promoter for failure and late delivery. In the event that the construction promoter goes bankrupt, you are assured that you will get your payments back. The same applies if the works are delivered late (+ 6 to 12 months) or defectively. From a legal point of view, this can be structured as a real bank guarantee or as an insurance policy.

Which payments are covered?

All payments are covered. Not only the interim payments but also the first down payment of the reservation contract and the VAT. The interest on your advance payments is also protected.

Who can apply for the bank guarantee?

According to Spanish law, the building promoter is required to provide the bank guarantee. It is true that a bank guarantee can only be issued after you have made the first down payment. In other words, when the first payment has been made to the account of the building promoter.

How long is the bank guarantee valid?

In principle, your payments are protected until your villa is delivered. Legally, the delivery takes place when the “Licencia de Primera Ocupacion” is issued by the Municipality. This document states that the structure meets the local housing standards, and it is also necessary if you wish to rent it out later.

Most banks in Europe do not easily provide funding for your second home.
